Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the GiveLocally mobile application and website (the "Platform"), operated by GiveLocally Technologies Private Limited ("GiveLocally", "we", "our", or "us"), a company incorporated under the laws of India.

By downloading the app, registering an account, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years of age to use GiveLocally. By using the Platform you represent and warrant that you meet this requirement. If you are using the Platform on behalf of an organisation (such as an NGO, housing society, or office), you represent that you have authority to bind that organisation to these Terms.

3. The GiveLocally Platform

GiveLocally is a community-based platform that facilitates the free exchange of goods between individuals, housing societies, offices, and NGOs within the same locality. The Platform allows users to:

• List items they wish to give away at no cost to the receiver.
• Browse available donations and submit a claim request.
• Coordinate item pickup via OTP-based exchange confirmation.
• Organise community donation events through the GiveLocally Events feature.

GiveLocally acts solely as a platform connecting givers and receivers. We are not a party to any exchange of goods between users and do not take ownership, custody, or title of any listed items.

4. User Accounts

To use most features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials secure and not share them with others.
• Notify us immediately at connect@givelocally.in if you suspect unauthorised access to your account.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, harmful, or abusive behaviour.

5. Listing Rules

When listing an item on GiveLocally, you agree that:

• The item is genuinely available and in your possession.
• The item is legal to give away under applicable Indian law.
• You will not list counterfeit goods, stolen property, hazardous materials, controlled substances, weapons, or any item prohibited by law.
• Descriptions and photos accurately represent the item's condition.
• You will fulfil the exchange once a claim is confirmed with an OTP.
• You will remove listings promptly once an item has been given away.

GiveLocally reserves the right to remove any listing that violates these rules without prior notice.

6. Receiver Commitment Fee

To reduce no-shows and ensure genuine intent, receivers are required to pay a non-refundable commitment fee of ₹9 when claiming an item. This fee:

• Does not constitute payment for the item — all items on GiveLocally are free.
• Is processed securely via Razorpay and is subject to Razorpay's terms of service.
• Is forfeited if the receiver fails to complete the pickup after claiming.
• Is not transferred to the giver — it is a platform service fee.

7. Community Events

Users may organise community donation events through the Platform for a flat platform fee of ₹49 per event. By creating an event you agree to:

• Provide accurate details about the event including location, date, and type of items accepted.
• Not use the event feature for commercial purposes, fundraising, or political activities.
• Comply with any local permissions or regulations required for public gatherings.

GiveLocally is not liable for the organisation, safety, or outcome of any community event.

8. Prohibited Conduct

You agree not to use the Platform to:

• Harass, abuse, threaten, or intimidate other users.
• Post false, misleading, or deceptive listings.
• Use the Platform for any commercial sale of goods.
• Collect personal information about other users without their consent.
• Scrape, crawl, or systematically extract data from the Platform.
• Attempt to gain unauthorised access to the Platform or its systems.
• Impersonate any person or organisation.
• Violate any applicable law or regulation.

9. User Content

By posting content on the Platform (including listing photos, descriptions, and messages), you grant GiveLocally a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating and promoting the Platform. You represent that you own or have the right to share all content you post.

GiveLocally does not endorse any user-generated content and is not responsible for its accuracy or legality.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. GiveLocally does not warrant that:

• The Platform will be uninterrupted, error-free, or free of viruses.
• Items listed are accurately described or fit for purpose.
• Any exchange between users will be completed successfully.

Users interact with each other at their own risk. GiveLocally strongly recommends meeting in safe, public locations for item exchanges.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, GiveLocally shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, property damage, personal injury, or disputes between users.

Our total liability to you for any claim arising from these Terms shall not exceed the total fees you have paid to us in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless GiveLocally, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

14. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes via the app or email. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. If you disagree with the updated Terms, please discontinue use and delete your account.
